Terms and Conditions

By enrolling your child at Just 4 Kids Performing Arts, you accept these terms and conditions ("Terms & Conditions") and sign your agreement to them as an ongoing agreement between you and Just 4 Kids ("Agreement").The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled student ("Student") by a Parent and Just 4 Kids ("Just 4 Kids Performing Arts", "we", "our", "us") (trading as Just 4 Kids) and is valid at all times whilst the Student is enrolled on any Just 4 Kids activity and until such time as written notice is given in accordance with these Terms & Conditions.

Terms and Conditions

1. INTRODUCTION
 

1.1 These Terms & Conditions apply to all our Classes, Holiday Workshops/Clubs, Workshops and any additional products and/or services offered by Just 4 Kids Performing Arts.
 

1.2 For participation of a Student in a Just 4 Kids Performing Arts Activity, all Parents are required to consent to these Terms & Conditions by ticking the acceptance box for these Terms & Conditions when submitting an electronic booking form online. We may update these Terms & Conditions from time to time.
 

1.3 Any changes to these Terms & Conditions require the written consent or approval of Just 4 Kids.
 

1.4 A "Course" refers to a course of classes offering tuition in dance, drama, and singing which will be delivered during the Term (including online activities). Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.
 

1.5 "Holiday Workshop/Camp" refers to Workshops (including online activities) run by Just 4 Kids during the breaks between Terms.
 

1.6 "Term" refers to one normal academic term of Just 4 Kids Performing Arts during which Courses are run.
 

1.7 "Term Dates" refers to the dates for the relevant Term.

1.8 "Workshop" refers to a one-off course (including online activities) offering tuition in dance, drama, singing and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year.

1.9 “Online activity” refers to online streamed lessons and online Workshops utilising the Zoom platform, delivered by Just 4 Kids.

2. ENROLLING A NEW STUDENT IN A JUST 4 KIDS PERFORMING ARTS CLASS OR WORKSHOP
 

2.1 To apply for a place for a new Student in a Just 4 Kids class, the Parent must agree to these Terms & Conditions and fill in our Booking Enquiry form to request a place. Just 4 Kids will let you know whether there is space in the class you'd like or if you will be added to our waiting list. Therefore, each Student's place is allocated on a 'first come, first served' basis., until our class is full.

2.2 If Just 4 Kids is unable to accept the Student due to capacity reasons, the Parent can contact Just 4 Kids directly to ask to be put on a waiting list and will be notified by Just 4 Kids when a space becomes available.

 

3. BALANCE PAYMENTS
 

3.1 When you book your child into our Shining Stars and Rising Stars classes, you are enrolling them for the foreseeable future and their space will remain in the class each term unless you choose to cancel their place.

3.2 For our Little Stars class, this will require you to book and pay for a place for your child for the session week by week. 

​

3.3 The full fees for the 11 or 12 week course of our Shining Stars and Rising Stars classes are paid in three installments direct debit from GoCardless. We will send you a direct debit mandate to get your banking details for collection. We will send you a reminder when the installment of fees are due.

​

3.4 Just 4 Kids do not offer refunds if you cancel your Child's place in our 11 or 12 week term outside of the cancellation period. See 4.2 and 4.3 for details on our cancellation period. 

 

4. TERMLY CLASSES
 

4.1 Once enrolled into the Shining Stars and Rising Stars classes, the Term Dates for the next Term will be made known to Parents at the end of the current Term. 
 

4.2 Unless Just 4 Kids is otherwise notified in writing by you to cancel your child's place at the end of a term, a Student is automatically re-enrolled onto next term. Fees due information will sent to you by email or text just over 1 week of when they are debited from your account.

4.3 You must give at least 1 weeks' notice before your fee instalment is paid to cancel your child's place.  If you do not cancel your child's place at least 1 weeks' notice of the fees being debited from your account, you will remain liable to pay the next instalment of your child's Term fees in respect of the next Term, regardless of attendance of the Student.

5. CLASSES- TRIALS AND ENROLMENT
 

5.1 We offer a trial session at the start of each new term to give children the opportunity to try it out and see if they like the class. You must contact us to enrol your child in to have a trial session. 

​

5.2 After this session, if your child does not wish to enrol for a termly classes, you will not be charged for this trial session. However, if your child chooses to enrol, you will be liable to pay for the full weeks of the term.
 

5.3 You may cancel the 12 week Term within five (5) calendar days after the end of the Trial Period and if any additional fees were paid then  Just 4 Kids will refund the Balance to you within fourteen (14) calendar days of your cancellation.
 

5.4 Once you have notified Just 4 Kids that you wish to cancel, the Student may no longer attend the Class.
 

5.5 If a Student later wishes to stop attending the Class during the Term, then Just 4 Kids is unable to refund  any amount paid  Term and notice for cancellation will take effect from the start of the next Term.

6. HOLIDAY WORKSHOPS/CLUBS
 

6.1 Parents should book a place for a child in any of our holiday clubs or workshops using www.bookwhen.com/just4kids
 

6.2 Dates and times of Holiday Workshops/Clubs are released in advance on the Just 4 Kids website and social media pages.
 

6.3 Full fees for the Holiday Workshops/Clubs are due at least 3 days before the first day of the  Holiday Workshop/Club. If you cancel 3 days or more of the Holiday Workshop/Club, you will receive a full refund within fourteen (14) days of the commencement of the Holiday Workshop/Club. If you cancel a Student's place within 3 days of the Holiday Workshop/Club commencing, you will receive only 50% refund of total fees paid.  If you cancel a Student's place from day 1 of the Holiday Workshop/Class commencing, you will not be entitled to a refund.

7. USE OF PERSONAL INFORMATION
 

7.1 The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be processed by Just 4 Kids. A hard copy of the Privacy Policy can be requested from j4kperformingarts@yahoo.com
 

7.2 Just 4 Kids owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Class/term, Holiday Workshop/Club is owned by Just 4 Kids.

8. HEALTH AND SAFETY
 

8.1 Students participate at their own risk and are obliged to inform Just 4 Kids and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to Just 4 Kids immediately in writing.
 

8.2 If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student on a Just 4 Kids activity.
 

8.3 Any medication left on the premises must be clearly labelled and Just 4 Kids notified by the Parent about the medication. The Student should, unless Just 4 Kids has agreed in writing otherwise, be able to administer it themselves. If Parents require Just 4 Kids to administer any medication, the Parent must complete a Medicine Agreement Administration form, collected from Just 4 Kids. 
 

8.4 Students must wear suitable footwear, joggers, leggings or sports trousers, t-shirts (or one of branded t-shirts), long hair must be tied up, no jewellery other than small studded earrings is allowed.

8.5 If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided below or on the enrolment form. This number must always be contactable whilst the Student is attending the Just 4 Kids classes or workshops. 

8.6 Parents are solely responsible for ensuring that the emergency contact details on Just 4 Kids' records are up to date.

8.7 All online activities are recorded and held for a period of four weeks for safeguarding and quality review purposes.

9. PERSONAL PROPERTY
 

9.1 Students are obliged to take care of their own belongings. Just 4 Kids can accept no liability for lost or damaged belongings.
 

9.2 The liability of Just 4 Kids and that of its staff is restricted to class time only and then only to gross negligence.

 

10. GENERAL
 

10.1 Just 4 Kids may, at its own discretion, refuse a Student entry to a Just 4 Kids Activity if it is felt that the Student's behaviour is unacceptable. Staff will try their best to deescalate situations if safe to do so. Parents will be notified at the end of class or called immediately, depending of the types of behaviour their Child is demonstrating.
 

10.2 Just 4 Kids reserves the right to make changes to the timetable, the teaching staff, the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online zoom classes, change venue or teacher) in the event of illness or other circumstances beyond our control.
 

10.3 Where a session has to be cancelled by Just 4 Kids, we will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated Just 4 Kids social media site. Parents must ensure that they provide Just 4 Kids with up-to-date contact details.

10.4 In the event of a session being cancelled, Just 4 Kids will provide substitute lessons where possible either at an alternative time, venue or online.  If no alternative can be offered, Just 4 Kids will provide refunds for lessons that are unable to be fulfilled.

 

10.5 It is occasionally necessary to change the time and/or venue of a Just 4 Kids session. This will only be done if absolutely necessary and Just 4 Kids will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed. Holiday Clubs/Workshops may be held in a different venue due to the capacity being greater. We will ensure this new venue is within the Truro area. 
 

10.6 In the event that a Student is unable to attend a Just 4 Kids session, due to sickness, holiday or a decision by the Parent or Student not to attend, Just 4 Kids regrets that it is unable to refund any payment.
 

10.7 All Students must be collected on time after a session. Just 4 Kids is unable to supervise Students after a session and consistent late collection will result in additional charges.
 

10.8 Just 4 Kids fees are reviewed annually and may be increased each year.
 

10.9 These Terms & Conditions, together with any Fee Note or Acceptance Letter, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
 

10.10 In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
 

10.11  The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
